TERMS & CONDITIONS

Please read these General Conditions for Participation in EuroGames 2004 carefully, these will form a legal contract between yourself as participant (the "Participant") and the organisers of EuroGames 2004 (the "Organisers") in the context of EuroGames 2004 in Munich.

As part of the accreditation process when you arrive in Munich, you will be presented with these General Conditions for Participation again. You will be asked to read them again and to sign a declaration that you have read, agree and understood them. Your signature is necessary before you can be issued with your Participant's Pass for EuroGames 2004.

General Conditions for Participation in EuroGames 2004

IScope of application
1.The EuroGames 2004 are organised by EuroGames München e.V. (the "Organisers").
2.EuroGames München e.V. acts hereby under the assignment of the EGLSF (European Gay and Lesbian Sport Federation).
3.The following General Conditions for Participation apply for all the events carried out by the Organisers within the scope of EuroGames 2004.
IIOrganisation/Tournament direction
1.The overall organisation is the responsibility of the Organisers.
2.The tournament direction is the responsibility of the tournament officials.
3.The Organisers and the tournament direction reserve the right to delegate certain assignments to qualified officials (in particular to referees).
4.The Organisers reserve the right for their tournament officials to re-grade sports Participants where the Registrant has selected a category or other classification. The Organisers reserve the right to combine or eliminate categories or other classifications at their own discretion, should this be necessary.
5.The Organisers, the tournament direction or their officials (such as referees) will make and will be responsible for decisions within the scope of their respective responsibilities. These decisions are final.
6.The Organisers will use their best endeavours to find a team for individuals who wish to take part in a team sport and have registered for the team sport, but who are not attached to a particular team. This accreditation does not guarantee the assignment to or the position within a team, which has been chosen by an individual.
IIIOrganisation and Implementation
1.Participation in all events of EuroGames 2004 is limited to registered Participants only. If required, Participants must produce their Participant's Pass to show their authorisation.
2.The Participant undertakes to abide by the General Conditions for Participation in EuroGames 2004 while taking part in all events.
3.The Participant acknowledges that deliberate or accidental failure to comply with, or any other contravention of, the General Conditions for Participation in EuroGames 2004 can result in the immediate disqualification from competitions and/or from EuroGames 2004. The responsibility for these decisions is in accordance with Clause II / 5.
4.The Participant is aware that some venues and institutions used by EuroGames 2004 for sports and cultural events may impose conditions for the use of the venues and similar facilities, and that such conditions must be complied with completely. Clause II / 3 may apply in the case of failure to observe such rules.
5.The Participant undertakes at all times to take part fairly in EuroGames 2004.
6.The Participant undertakes to abide by the written and/or verbal instructions of the Organisers, the tournament direction or their officials within the scope of the carrying out of the individual events.
7.The Participant is aware that deliberate or accidental failure to comply with, or any other contravention of, the instructions (as in Clause III / 6) can result in the immediate disqualification from the competitions and/or from EuroGames 2004. The responsibility for these decisions is in accordance with Clause II / 5.
8.In principle, events for EuroGames 2004 will be carried out under all weather conditions. The Organisers and the tournament direction reserve the right to cancel or postpone events, to change venues and to change timetables of events particularly if the health and safety of those involved is at risk. The responsibility for these decisions is in accordance with Clause II / 5
9.Should a Participant sustain an injury or illness while taking part in EuroGames 2004 he or she authorises medical personnel to perform first aid and medical treatment as deemed necessary including specialised medical care in hospitals and health care institutions if required.
IVBanned Substances
1.The Participant undertakes not to take any banned substances as defined by the regulations of the International Olympic Committee concerning banned substances.
2.The Organisers reserve the right to take urine samples from Participants.
3.The Organisers reserve the right to disqualify Participants who have taken banned substances to improve sports performance, as in Clause IV / 1.
VAwards ceremony
1.For each event the awards ceremony takes place immediately following the last round of the competition.
2.In line with competition rules for each sport, the Organisers will award gold, silver and bronze medals to those placed first, second and third, regardless of the number of Participants in the respective class, unless otherwise provided for by the rules of that sport.
3.The combining of classes or age groups as in Clause II / 4 will not affect the medals awarded in accordance with the rules of a particular sport.
VILiability
1.The Participant declares that he or she is sufficiently physically fit and in a healthy state required to participate in events in which he or she is entering and is not aware of any serious medical condition that would prevent him or her from participating in these physical activities. ( To avoid doubt, it is agreed that a "HIV-positive" diagnosis is not a "serious medical condition " for the purposes of this clause.)
2.The Organisers have limited legal liability for injuries to the participant's life, body and health. It is specifically made clear that any injuries to the participant's life, body and health caused by the failure to satisfy the preconditions for participation in Clause VI / 1 do not constitute grounds for liability of the Organisers.
3.The liability for further damages is limited to those caused by serious negligence.
4.Any claims against the Organisers must be made in writing.
VIIInsurance
1.The Organisers draw attention to the fact that not all accident and health care insurance policies and their compensations fully cover the risks in the context of such a sporting event.
2.The Participant him- or herself must therefore arrange for adequate insurance cover. This applies in particular to accident, health care and possibly also travel insurance. The Organisers have no obligations in this respect.
VIIILoss
1.In the case of loss or theft of the official EuroGames Pass a replacement can only be obtained from the sales point in the Rainbow Village on payment of the agreed fee.
IXRelease
1.All those who register for EuroGames 2004 (whether as Participant, referee, official, volunteer helper or in any other function) give their consent to the following: the absolute right and permission will be granted in perpetuity to EuroGames 2004 and the EGLSF and successor organisations, officials and to such other persons as they may designate (collectively, "Licensees"), to use one's name, likeness, voice or photograph, either alone or accompanied by other persons or material, in any manner and in any media, at any time, throughout the world for any lawful purpose.
2.The right is hereby waived to inspect or approve any photographs or other materials, the use, or such written or spoken version of which, as may be used in connection therewith. It is agreed that any photographs which may be made by the Licensees are the property of the Licensees. No obligation on the part of Licensees to make any use of all or any part of the name, likeness, voice or photograph is hereby established. Agreement is further given that neither the Licensees nor anyone who receives permission from them will be held responsible for any liability that may result from the use of the name, likeness, voice or photograph. This also includes any accidental misrepresentation of ones person.
3.The Participant affirms that he or she is fully familiar with the gymnastic, sporting or other equipment which he or she will use during EuroGames 2004, and has often previously performed gymnastic, sporting or other activities similar to those which will be performed in the context of the competitions in EuroGames 2004. The risks hereby involved are known.
XJurisdiction
1.In the case of a judicial dispute, the sole place of jurisdiction is Munich.
XIMiscellaneous
1.The Participant undertakes not to use the logo or other trademarks of EuroGames 2004 on personal clothing and/or team uniforms, merchandise or promotional material. (Among other considerations, the contractual agreements between the EGLSF and EuroGames 2004 apply here).
2.The Participant undertakes not to act in any way which would compete with the rights of the sponsors EuroGames 2004 or which would devalue the rights regarding potential marketing of the logos, the presence of which is exclusively limited to the event venues of EuroGames 2004.
3.Should during EuroGames 2004 the Organisers, the tournament direction or an official determine that an action offends against the undertaking in Clause III / 2, the Participant undertakes to cease the offending action. This applies equally to uniforms, symbols or other objects which give rise to such offence. In serious cases an offence against the undertakings in Clause III / 1 or 2 can result in the immediate disqualification from competitions or from EuroGames 2004. The responsibility for these decisions is in accordance with Clause II / 5.
4.The refund of payments is at the sole discretion of the Organisers.

 

I agree that my personal information collected for the registration for EuroGames 2004 may be stored for the purposes of distribution of publications and informational material. Organisers agree to not sell or trade with any of the collected addresses or information. I also agree to the provision of my personal data to the EGLSF and its successor organisations.
